Lawsuit to block foreclosures in Minnesota dismissed

A federal judge in Minneapolis has dismissed a lawsuit filed by a group of homeowners in the Twin Cities that charged loan service companies are improperly implementing the federal government’s loan modification program.

The lawsuit, which was filed this summer by a public interest group in St. Paul, also asked U.S. District Judge Ann Montgomery to issue an injunction that would prevent bank foreclosures in Minnesota from going forward. That request was denied, Montgomery wrote in an order issued Monday.

Mark Ireland, the attorney who brought the suit by the Foreclosure Relief Law Project, said in a statement that the group was reviewing the decision to determine if it would pursue an appeal.
